In an escalating legal battle, OpenAI has countersued Elon Musk, accusing him of harassment and seeking a federal court order to prevent any further unlawful actions against the company. The lawsuit centers on the future structure of OpenAI, which Musk co-founded in 2015 but left before the company became a technology powerhouse.

The conflict between OpenAI and Musk has intensified since Musk’s departure from the company, with the billionaire now leading his own AI venture, xAI, which he founded in 2023. OpenAI must complete this transition by the end of the year to meet its funding goals.

OpenAI’s countersuit accuses Musk of launching a series of aggressive and harmful actions, including press attacks, legal harassment, and a sham bid for the company’s assets. The company filed the lawsuit in the US District Court for the Northern District of California, demanding that Musk be stopped from any further interference and held accountable for the damage already caused.

In response, Musk’s legal team referenced a $97.4 billion unsolicited takeover bid for OpenAI earlier this year, which the company rejected. Musk’s lawyer, Marc Toberoff, argued that OpenAI failed to properly consider the bid, claiming that the rejection interfered with OpenAI’s business plans.

Musk also responded through his social media platform, X, claiming that OpenAI’s actions were an attempt to hinder competition. In a post on X, OpenAI described Musk’s continuous attacks as bad-faith efforts to slow down the company and seize control of AI innovations for Musk’s personal benefit.
